Welcome to The Gifted Agent™. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (the “User,” “you,” or “your”) and The Gifted Agent, LLC (“Company,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Wisconsin, regarding your access to and use of the website located at https://www.thegiftedagent.com (the “Site”), and any products, services, courses, coaching, tools, or memberships offered through the Site (collectively, the “Services”).
By accessing, purchasing, or using any part of the Site or Services, you accept and agree to be bound by these Terms. If you do not agree, do not access the Site or purchase our Services.
1. Use of the Site and Services
You may use this Site and its Services for lawful, personal, and non-commercial use only. You may not copy, distribute, reproduce, or exploit any portion of the Site or its contents without our express written permission.
We reserve the right to deny, suspend, or terminate your access to the Site or Services, in whole or in part, at any time, and for any reason, including, but not limited to, violation of these Terms.
2. Intellectual Property and License
All content on this Site—including but not limited to course materials, videos, text, graphics, branding, digital downloads, templates, coaching materials, and documents—is the exclusive property of The Gifted Agent, LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
Upon purchase, you are granted a limited, non-transferable, non-sublicensable, non-exclusive, revocable license to access and use the course materials for your own personal, non-commercial use only. This license does not permit you to share, reproduce, resell, modify, or distribute any materials.
Any unauthorized use may result in the immediate termination of your access and may subject you to legal liability.
3. Refund Policy and Access
We offer a 7-day refund policy from the date of purchase. Refunds are only granted under the following conditions:
- You must request the refund in writing by emailing [email protected] with the subject line: “Refund Request.”
- Include your full name, purchase date, course title, and a brief explanation for your request.
- You must provide proof that you accessed and completed available content (e.g., completion of Module 1).
After 7 days, no refunds will be issued under any circumstances.
Access to the full course beyond Module 1 will be granted after the 7-day period has elapsed.
4. Payment Terms
If you select a payment plan, you are legally obligated to complete all scheduled payments, even if you choose not to complete the course. Payment plans are non-refundable. Failure to make timely payments may result in:
- Suspension or termination of access to course content
- Referral to collections or legal action
- Ineligibility to enroll in future offers
5. Third-Party Payment and Financing
We use Kajabi Payments via Stripe for secure transactions. By purchasing from us, you also agree to be bound by the terms of our payment processors:
If you use Buy Now, Pay Later services (e.g., Klarna or Afterpay), you are entering a separate financial agreement with that provider. You are responsible for all obligations under their terms:
6. Lifetime Access
Unless otherwise stated, course purchases include lifetime access to the purchased materials. “Lifetime” is defined as the lifetime of the course. Should we choose to retire or discontinue the course, users will be given 60 days’ notice and access to download any applicable resources.
We reserve the right to revoke access to any user at any time for violation of these Terms or any applicable laws.
7. Community Standards and User Conduct
Users may participate in lesson-based comments and discussions. By participating, you agree:
- To treat others with professionalism and respect
- Not to post hate speech, offensive language, spam, self-promotion, or harassment
- To use the space for encouragement, questions, and relevant dialogue only
Violation of these standards may result in permanent removal from the course and any related communities—without refund.
8. Disclaimers and Limitations of Liability
The Gifted Agent™ provides educational content only and is not a substitute for legal, financial, tax, brokerage, or regulatory advice.
We make no guarantees about your ability to earn income or achieve specific results. Your success depends on many factors, including your personal effort, market conditions, business acumen, and adherence to industry standards.
You agree that we are not liable for any direct, indirect, incidental, or consequential damages that may result from your use of or inability to use the course or Services.
9. Professional Advice Disclaimer
While we offer business education related to the real estate profession, you should always consult:
- A licensed tax professional for any financial decisions
- Your brokerage for compliance with local, state, and federal real estate laws
- State and federal laws, including RESPA and Fair Housing regulations
10. Testimonials and Individual Results
Testimonials shared on the Site or in our marketing materials reflect the personal experiences of individual users. They are not representative of all users and are not guarantees of results. Your outcomes may vary.
11. Data Collection and Privacy
We collect your name, email, mailing address, phone number, and payment information in accordance with our Privacy Policy.
We use Kajabi to store and manage user data, and Kajabi may collect usage data in accordance with its policies.
We use marketing tools including but not limited to email campaigns, Facebook Pixel, and Google Analytics. You may unsubscribe at any time using the link in our emails.
To request access, correction, or deletion of your personal data, please email [email protected].
12. Subscription & Membership Policies (Coming Soon)
When active, users will be able to cancel subscriptions by providing a 30-day notice prior to the next billing cycle. Access will remain active through the end of the paid term.
13. Children’s Use of the Site
Our Services are intended for adult real estate professionals. We do not knowingly collect information from anyone under the age of 18.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws principles.
15. Dispute Resolution and Class Action Waiver
You agree to first attempt to resolve any dispute through informal negotiation. If unresolved, disputes shall be submitted to binding arbitration in Wisconsin.
You waive the right to participate in any class action lawsuit related to the Site or Services.
16. Modifications and Notification
We reserve the right to modify these Terms at any time. Updates will be posted to this page and users may be notified by email if changes are substantial. Your continued use of the Site or Services constitutes acceptance of updated Terms.
